For property compliances and nuisance violations, such as tall grass and weeds, junk and debris, and other various Code and Housing violations, the City of Sacramento uses a Code Enforcement Hearing process for resolution and compliance. The process streamlines ordinance enforcement and expedites the adjudication process, thereby enhancing the quality of life for City of Sacramento residents.

Types of hearings

  

Code Compliance Hearing Examiner

The Code Enforcement Hearing Examiner is responsible for presiding over the proceedings related to appeals to Code Enforcement actions. The Hearing examiner and/or the secretary will administer oaths, examine witnesses, receive evidence, hear arguments, analyze, and evaluate facts and pertinent ordinances to prepare an independent judgment. The Hearing Examiners are approved by the City Council but are not City employees. These meetings are held on the second and fourth Wednesday of each month beginning at approximately 9:00 a.m. and ending at 1:00 p.m.

Business Code Compliance Hearing Examiner

The Business Code Enforcement Hearing Examiner is responsible for presiding over the proceedings related to appeals to Code Enforcement actions. The Business Code Compliance Hearing examiner and/or the secretary will administer oaths, examine witnesses, receive evidence, hear arguments, analyze, and evaluate facts and pertinent ordinances to prepare an independent judgment. The Business Code Compliance Hearing Examiners are approved by City Council but are not City employees.

These meetings are held on the first and third Thursday of each month beginning at approximately 1:00 p.m. and ending at 5:00 p.m.

Housing code advisory and appeals board

The Board is a five-member Board (not employees of the City) appointed by the Mayor and confirmed by City Council.

Section 8.100.120 of the City Code, City Ordinances 2008-013 and 95-054, as well as City Resolution 81-476, give the Board the authority to:

  • Provide for final interpretation of the provisions of the “Housing Code” (Chapter 8 of the Sacramento City Code).
  • To hear cases involving the repair or demolition of substandard and/or dangerous buildings as well as appeals of substandard and/or dangerous buildings cases.

The Housing Code Advisory and Appeals Board will meet on the second Wednesday of each month. Meetings are held at Historic City Hall at 5:30 p.m.

Delinquency lien hearing officer

The Code Compliance Division is in the practice of assessing fees and fines to collect cost and encourage compliance. To provide relief to property owners that are experiencing financial hardships and are unable to pay the fees and fines levied against their property, the Code Compliance Division offers a Delinquency Lien Hearing. The hearing is an opportunity for a property owner to demonstrate their inability to pay to a Delinquency Lien Hearing Officer (DLHO). The DHLO is responsible for hearing all protests and objections relating to the assessment of fines and fees by parties of interest and evaluating all evidence provided to determine if sufficient evidence was provided justifying a financial hardship.

Pursuant to Sacramento City Code section 8.04.380, the department head shall give notice of the hearing scheduled before the DLHO at least 30 days prior of the scheduled hearing. The notice shall state that all protests or objections shall be filed in accordance with section 8.04.400 of the city code. The intent of the Delinquency Lien Hearing is to ensure that the City of Sacramento is not displacing property owners caused by the assessment of fees and penalties against property owners that are experiencing a financial hardship and provide financial relief.

These hearings are held once a month on the 3rd Wednesday beginning at 9:00A.M.
