2018-03-18: 7500 block of 29th Street

Summary

On Sunday, March 18, 2018, at 9:13 p.m., officers from the Sacramento Police Department (SPD) were dispatched to the 7500 block of 29th Street regarding a subject breaking into vehicles. The caller stated that the male subject had broken car windows and was now hiding in a backyard. The caller described the subject as a male, 6’, thin, wearing a black hoodie and dark pants. SPD Officers arrived on scene at approximately 9:18 p.m. This incident resulted in an officer-involved shooting.

Due to the severity of the event, Detectives conducted a thorough canvas of the neighborhood. During the canvas, investigators identified at least three vehicles with damage believed to have been caused by the suspect. In addition, an adjacent and occupied residence had a sliding glass door shattered. Orbiting deputies in the Sacramento Sheriff’s Department’s law enforcement helicopter had witnessed the suspect shatter the door and run from one property and jumped the fence into another property where the shooting occurred.

Prior to the shooting, the involved officers saw the suspect facing them, advance forward with his arms extended, and holding an object in his hands. At the time of the shooting, the officers believed the suspect was pointing a firearm at them. After an exhaustive search, scene investigators did not locate any firearms. The only items found near the suspect was a cell phone.

Audio and video releases

On March 21, 2018, the Department released video and audio material related to this incident. The material consists of two (2) body-worn camera videos, one (1) video from the Sacramento Sheriff’s Department’s helicopter (STAR) and two (2) audio files. The two (2) body-worn camera videos begin as the officers arrive on scene. The helicopter video footage begins with the suspect running from a backyard and jumping over a fence into the property where the shooting occurred. One audio file consists of the 9-1-1 call that our Communication Center received regarding the incident. The additional audio file contains dispatch radio traffic related to the event.

On April 16, 2018, the Department released secondary video and audio material consisting of 23 in-car camera (ICC) videos, 28 body-worn camera (BWC) videos, two 9-1-1 audio files and the remaining video from the Sacramento Sheriff Department's Helicopter (STAR). The BWC and ICC videos contained in this release depict officers responding to the scene after the officer-involved shooting (OIS) occurred, and their activities upon arrival. The time frame of this material is from when the officers begin their response to when the Sacramento Fire Department declares Mr. Clark deceased. The helicopter footage begins at the end-point of the previous release to the end of the footage. The audio files consist of two 9-1-1- transfer calls from the California Highway Patrol.

On September 26, 2019, the Department released additional audio and video material relating to, or utilized during, our Internal Affairs investigation into this officer-involved shooting in accordance with Cal. Pen. Code Sections 832.7 and 832.8. As these materials were specifically utilized or created throughout the Internal Affairs investigation, they have been collected and released as a separate playlist. This release included audio material consisting of one (1) recording of dispatch radio traffic and six (6) recordings of Internal Affairs interviews. This release also included video materials consisting of one (1) video of helicopter footage from STAR, four (4) videos from Homicide interviews, and seven (7) BWC videos from Sacramento Police Department Officers.

All video and audio being released have been redacted to ensure the confidentiality and privacy of those involved. The faces and/or identifying materials have been blurred, and audio redactions are signified by muted audio with no accompanying sound. This incident falls under the City Council policy on Police Use of Force. The Police Department released this material to provide information quickly to our community.

Status updates

On February 12, 2019, the Sacramento Police Department conducted its Preliminary Review into this incident. The Preliminary Review is an initial high-level review of the incident to evaluate our organizational performance in any significant event. 

On March 02, 2019,  the Sacramento County District Attorney's Office concluded its investigation and released its findings

On June 11, 2019 the Sacramento Police Department conducted its Final Policy Review covering the specific use of force from this incident., addressing SPD's findings and recommendations.
